Family Defense Practice
The Bronx Defenders’ Family Defense Practice (FDP) provides legal representation and social work support to parents charged with child abuse and neglect who are at risk of losing custody of their children. Our Family Defense Practice is at the forefront of a movement to provide holistic representation to parents in the Bronx while creating long-term solutions for the reunification and stability of families. Family Defense Practice Attorneys primarily litigate abuse and neglect cases, but occasionally appear in concurrent matters including custody, visitation, and termination of parental rights.
Complex Family Defense Litigation
Attorneys and Advocates in the Family Defense Practice assigned to complex litigation cases represent parents and caregivers in court cases and pre-court ACS investigations in which parents are facing the removal of their children due to medically complex allegations and in some cases after the death of a child. Those include allegations of abusive head trauma, shaking, fractures, burns, and other serious alleged non-accidental findings. These cases are as medically and strategically complex, as any criminal homicide case, and require understanding of medical findings and diagnosis, extensive record gathering, motion practice, and litigation. Representation in these cases almost always requires collaboration with medical and other experts and often includes a partnership with pro bono firm attorneys. FDP attorneys working on these cases require specific and extensive litigation support in the form of regular case conferencing, specialized training, co-counseling, and up-to-date information about the law of res ipsa, abusive head trauma and other complex medical issues, as well as new developments in the relevant science and medical research.
Responsibilities
Reporting directly to the Director of Complex Litigation, the Complex Litigation Supervising Attorney will carry a reduced caseload while supervising attorneys representing parents and caregivers in cases where parents are being investigated or have been charged with abuse or neglect based on complex medical findings and diagnosis.

6 years of directly relevant experience, the salary range for this position would be approximately $96,400 – 105,040. Full-time employees are also eligible for a comprehensive benefits package including but not limited to medical, dental and vision coverage; a 403(b) plan with employer contribution; a generous vacation, sick leave, and parental leave policy. Approximately 70% of The Bronx Defenders' staff, including attorneys and non-attorneys, are represented by UAW Local 2325 - Association of Legal Aid Attorneys (AFL-CIO). This position is not within the bargaining unit.
This position is exempt. By law, non-exempt employees are compensated hourly based on their annual rate and therefore are entitled to over-time, whereas exempt employees are not.
